Jurisdiction

2. All sapient species and all species which are members of the Empire are protected by the Criminal Code.

118. A species is sentient if its members are capable of perceiving and feeling stimuli.

119. A species is sapient if its members possess the level of intelligence necessary for the creation of civilisation.

120. A person is any member of an Empire species or any sapient species.

121. A citizen is a member of the Empire who has been granted citizenship. There are 3 tiers of citizenship.

Offences

230. (a) Criminal offences are designated into three tiers of severity: Summary, Indictable, and High.
(b) A criminal offence will be raised to the next tier of severity the third time the individual commits the same offence in one year.
(c) A criminal offence may be raised to the next tier of severity based on judicial discretion having regard to the circumstances of the offence and the victim.

Property Offences

416. (a) It is Theft to take or convert a person's property without colour of right.
(b) Property damage is considered theft.
(c) Theft is a Summary offence.

417. (a) It is Endangerment to wilfully or negligently damage property which is necessary to sustain life or community safety.
(b) Endangerment is a Summary offence except when committed in space.
(c) Endangerment committed in space is an Indictable offence.

Possession Offences

481. (a) It is Unlicensed Activity to perform an action without the proper License.
(b) Unlicensed Activity is a Summary offence.

482. (a) It is Possession to possess an item listed in section VI of the Controlled Items Act.
(b) It is a defence to the crime of possession if the possessor was in the process of delivering the item to the local authorities with all due haste.
(c) It is a defence to the crime of possession to have an appropriate license active for the item.
(d) Possession is a Summary offence.

483. (a) It is Smuggling to possess Feroxidite.
(b) Smuggling is a High crime.

Violent Offences

620. (a) It is Threatening to convey a message to another person with the intent to threaten their safety.
(b) Threatening is a Summary offence.

621. (a) It is Assault to, without consent, apply or by word or action threaten to use force against another person without due cause.
(b) Assault is a Summary offence except when committed against a Tagni Ord or Camera Operator during an Away mission.
(c) Assault committed against a Tagni Ord or Camera Operator during an Away mission is a High offence.

622. (a) It is Manslaughter to
(i) end the life of a person recklessly, or
(ii) end the life of a non-person sentient without due cause.
(b) Manslaughter is a Summary offence except when committed against an Empire member species.
(c) Manslaughter committed against an Empire member species is an Indictable offence.

623. (a) It is Murder to, without consent, intentionally end the life of a person.
(b) Murder is an Indictable offence except when committed against an Empire member species.
(c) Murder committed against an Empire member species is a High offence.

Decency Offences

754. (a) It is Modification to genetically modify a person beyond the standards set out in section 4 of the Modification of Persons Act.
(b) Modification is an Indictable offence.

779. (a) It is Treason to intentionally or recklessly act against the interests of the Empire.
(b) Treason which does not rise to the level of criminality is dealt with in part 6 of the Insubordination Act.
(c) Treason is a High offence.

Sentencing

811. Sentencing is determined based on the discretion of the Judge having regard to all the circumstances, including the circumstances of the offence, the offender and the victim.

812. Sentences may be appealed to the Court of Appeals on Old Earth using Form VII.2.
